Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("AUP") defines the rules and guidelines for using the Marketfier platform. It supplements our Terms of Service and applies to all users. Violation of this policy may result in account suspension or termination.
2. Prohibited Activities
You may not use the Platform to:
2.1 Spam and Unsolicited Messaging
- Send bulk unsolicited emails or SMS messages.
- Send messages to purchased, rented, or scraped contact lists.
- Send messages without verifiable recipient consent.
- Falsify sender information or use misleading subject lines.
- Harvest email addresses or phone numbers from websites or directories.
2.2 Illegal or Harmful Content
- Promote or facilitate illegal activities.
- Distribute content that infringes on intellectual property rights.
- Host or distribute malware, ransomware, or phishing content.
- Engage in fraud, identity theft, or financial crimes.
- Distribute content depicting violence, abuse, or exploitation.
- Promote regulated products (gambling, cannabis, firearms, pharmaceuticals) without proper compliance.
2.3 System Abuse
- Attempt to access other users' accounts or data.
- Circumvent security measures, rate limits, or access controls.
- Use automated tools to scrape, crawl, or extract data from the Platform beyond intended API usage.
- Interfere with Platform infrastructure or degrade service for other users.
- Reverse engineer, decompile, or disassemble Platform components.
- Use the Platform to conduct denial-of-service attacks or other network abuse.
2.4 Messaging Abuse
- Send messages with deceptive or misleading content.
- Use the Platform to conduct phishing or social engineering attacks.
- Send messages that violate TCPA, CAN-SPAM, GDPR, CASL, or other applicable regulations.
- Fail to honor opt-out, unsubscribe, or STOP requests within the required timeframe.
- Send messages outside the scope of the recipient's original consent.
- Use shared or pooled short codes for unauthorized purposes.
2.5 Payment and Financial Abuse
- Use the Platform to facilitate money laundering or fraudulent transactions.
- Create fake events or bookings to process unauthorized payments.
- Misrepresent pricing, refund policies, or terms to customers.
- Act as or hold yourself out as a payment facilitator, intermediary, or aggregator.
3. SMS Messaging Rules
3.1 Consent Requirements
Before sending SMS messages through the Platform, you must:
- Obtain explicit opt-in consent from each recipient via a clear call-to-action (web form, checkbox, or keyword).
- Clearly inform recipients of the types of messages they will receive.
- Disclose expected message frequency.
- Include the statement "Message and data rates may apply."
- Provide opt-out instructions (reply STOP).
- Provide help instructions (reply HELP).
- Link to your Privacy Policy and Terms of Service from the opt-in point.
- Maintain records of consent for each recipient.
3.2 Opt-In Checkboxes
SMS consent checkboxes on web forms must be:
- Unchecked by default (not pre-selected).
- Separate from general Terms of Service or Privacy Policy consent.
- Clear and specific about SMS messaging.
3.3 Required Message Elements
All SMS messages must include:
- Clear sender identification (your business name).
- Opt-out instructions on at least the first message and periodically thereafter.
3.4 Prohibited SMS Content
Do not send SMS messages containing:
- Content promoting age-restricted products without proper compliance.
- High-risk financial services (payday loans, debt collection, cryptocurrency trading).
- Content that violates carrier acceptable use policies.
- Links using free URL shorteners (bit.ly, tinyurl, etc.). Use branded domains only.
3.5 Message Frequency Limits
- Booking reminders: Up to 3 messages per booking.
- Event notifications: Up to 5 messages per event.
- Messages must align with the frequency disclosed at the time of opt-in.
4. Email Messaging Rules
4.1 Compliance
All emails sent through the Platform must comply with CAN-SPAM (US), GDPR (EU/EEA), CASL (Canada), and any other applicable anti-spam legislation.
4.2 Requirements
All marketing emails must include:
- Accurate sender information and "From" name.
- A clear, functioning unsubscribe mechanism.
- Your physical mailing address or registered agent address.
- Truthful subject lines that reflect the message content.
4.3 Unsubscribes
Unsubscribe requests must be honored within 10 business days (CAN-SPAM requirement). The Platform processes unsubscribes automatically; do not re-add unsubscribed contacts to active lists.
4.4 Sending Thresholds
We monitor email deliverability metrics. Accounts that consistently exceed the following thresholds may be subject to review or restriction:
- Bounce rate above 5%.
- Spam complaint rate above 0.1%.
- Unsubscribe rate above 2% per campaign.
5. Data Handling
5.1 Contact Data
- Only import contacts who have given you permission to receive communications.
- Do not upload contacts obtained through deceptive means, purchased lists, or scraping.
- Regularly clean your contact lists to remove invalid, bounced, or unresponsive entries.
- Respect and promptly fulfill all data subject rights requests (access, deletion, correction).
5.2 Sensitive Data
Do not store the following in the Platform without appropriate safeguards and legal basis:
- Social Security numbers or government identification numbers.
- Protected health information (PHI/HIPAA).
- Financial account numbers beyond what Stripe processes.
- Passwords or authentication credentials of your contacts.
- Biometric data.
6. Enforcement
6.1 Monitoring
We reserve the right to monitor Platform usage for compliance with this AUP. Monitoring may include reviewing delivery metrics, bounce rates, complaint rates, and opt-out rates.
6.2 Actions We May Take
If we determine that you have violated this AUP, we may, at our sole discretion:
- Issue a warning and request corrective action within a specified timeframe.
- Temporarily suspend your messaging or campaign capabilities.
- Temporarily suspend your entire account.
- Permanently terminate your account.
- Report illegal activity to appropriate authorities.
The severity of the action will be proportional to the violation. We will make reasonable efforts to notify you before taking action, except in cases of severe or ongoing harm.
6.3 Appeals
If you believe enforcement action was taken in error, you may appeal by contacting [email protected] within 15 days. We will review and respond within 10 business days.
